Club Bylaws

ARTICLE I: NAME
The name of this organization shall be “The Buena Vista Sportsmans Club, Inc.”
ARTICLE II: Objectives
The Buena Vista Sportsmans Club, Inc., heretofore the Club, is a non-profit membership corporation whose purpose shall be the encouragement of organized rifle, pistol and shotgun shooting among the citizens and permanent residents of the United States of America, with a view toward a better knowledge on the part of such persons of the safety, handling, proper care of firearms and improved marksmanship.
ARTICLE III: Membership
Any citizen of the United States of America, 18 years of age or older, may become a member of the club upon payment of the annual dues and by an affirmative vote of the majority of the members present at a regular scheduled meeting. All members are encouraged to maintain membership in the National Rifle Association.
Special junior membership shall be available for persons between the ages of 12 and 18 years upon payment of the annual junior membership dues and by an affirmative vote of the majority of the members present at a regular scheduled meeting. Junior members shall be entitled to all the privileges and are required to perform all the duties of a regular member except where restricted by the rules of affiliated national organizations and club rules.
By a majority vote of active membership at any regular scheduled meeting any suitable person may be elected to HONORARY Membership in the club. No annual fee or dues shall be required of such an honorary member.
ARTICLE IV: Dues
The members annual dues to the club shall be payable prior to January 1st of each year or upon becoming a member. The amount of the annual dues shall be determined by Majority vote of the members in good standing at the January (annual) meeting of the club. Families can join at an additional cost defined at the annual meeting. Any member in arrears of the club dues exceeding four (4) full months shall be ineligible to vote or enjoy any of the privileges and benefits offered by the club. Field determination of current membership shall be by color of the membership card, which will change every year.
ARTICLE V: Meetings
Regular club meetings shall be held no less than once each month of the year. Date, time and place shall be established by majority vote of the members at the annual meeting. The annual meeting of the club shall be held during the month of January. The date, time and place of the meeting shall be set by the executive committee.
A special meeting of the club may be called by the executive committee. Any request for a special meeting is to be made to all the members of the executive committee. All meetings shall be conducted according to the parliamentary rules of order and open discussion from the floor on all measures shall be permitted and encouraged.
ARTICLE VI: Management
The management of the Club shall be by President, Vice-President, Secretary, Treasurer and Executive Officer, with the cooperation of a Shotgun Chairman, Rifle Chairman and Pistol Chairman.
ARTICLE VII: Officers
The officers of the club shall be President, Vice-President, Secretary, Treasurer and Executive Officer, acting together shall constitute the executive committee. They shall be elected by a majority vote, by ballot, of the members in good standing at the annual meeting of the club. They shall hold office for one (1) year or until their successors is elected. The offices of Secretary and Treasurer may be combined. If a vacancy in the executive committee should exist, it shall be filled by selection of the President at the next regular meeting, so as to complete the remaining term of office. With the approval by a majority of the members present eligible to vote.
ARTICLE VIII: Duties of the Officers
President: The president will preside at all meetings of the club and of the executive committee. He/she shall be a member ex-officio of all regular and special committees, and shall perform all such other duties as usually pertain to his office.
Vice-President: The vice-president will perform all the duties of the president in his/her absence or at his/her request.
Secretary: The secretary will conduct all official correspondence pertaining to the proper functioning of the club. He/she will notify all members of meetings, keep a true record of such meetings and have custody of the books and official papers of the club, except the Treasurer’s books of account. He/she will be responsible for the collection of all fees and dues and shall remit the same to the treasurer, taking his/her proper receipt thereof. The secretary shall prepare and distribute the previous month minutes at each meeting.
Treasurer: The treasurer will have charge of all funds of the club and place the same in such bank or banks as may be approved by the executive committee. Such money will be withdrawn by check signed by the treasurer for the payment of such bills as shall have been approved by the members. Bills for operating matches may be paid out of the cash earned at such matches. The treasurer will keep an accurate account of all his transactions and render a detailed report at each monthly meeting or when requested to do so.
Executive Officer: The executive officer will assist the Executive Committee in the execution of their duties
ARTICLE IX: Duties of the Chairpersons
Shotgun Committee Chairperson: The shotgun committee chairperson is responsible for the organization and conduct of the trap, skeet, and five stand shoots. Duties of the chair may include maintenance of the area, equipment, safety, supplies and the generation of all affiliation paperwork and forms. The chair will provide a copy for the secretary’s books or provide the paperwork for the secretary to copy and mail. The chair may need to advertise and organize help to hold National and/or State organizations registered shoots. Fees paid to any organization are made by check from the treasurer. Pay out of winnings is either by cash or check with the accounting by the chair. All paid out and received balances at the end of a shoot will be reported to the Treasurer.
Rifle Committee Chairperson: The rifle chairperson is responsible for the organization and conduct of rifle competitive shoots. Among his/her duties are maintenance of the shooting areas, safety, equipment, supplies and the generation of all affiliation paperwork and forms. The chair will provide a copy for the secretary’s books or provide the paperwork for the secretary to copy and mail. The chair may advertise special events when one is planned otherwise the events calendar will be updated annually for the rifle division in the club house and on the BVSC web site.
Pistol Committee Chairperson: The pistol committee chairperson will be responsible for the organization and conduct of all pistol competitive shoots. Among his/her duties will be generating all affiliation paperwork and forms, the appointing and setting the duties of assistants, maintain the shooting area, safety, equipment, supplies, proper publicity of shooting events and reporting of shooting events to club members and the public. The Chair will provide a copy of affiliation paperwork to the secretary for inclusion in his/her books or the paperwork for the secretary to copy and mail.
ARTICLE X: Discipline
Censure
The purpose of a censure is to reprimand the member with the hopes of reforming him or her so that he or she won't behave in the same way again. Members can be censured for misconduct at meetings, violating confidentiality, moral misconduct outside the meeting, working against the organization, and violating other objectives and values that the organization upholds. Officers can be censured as well for behavior such as not performing duties, doing things beyond what the bylaws or organization has assigned the officer to do, and fraud. A presiding officer can also be censured for not following parliamentary rules in meetings, and for denying members their basic rights to make motions, participate in debate, and vote.
Procedurally, a censure needs a second, is amendable, debatable, requires a majority vote by ballot, and cannot be reconsidered. The member or officer being censured may come to his or her own defense during the debate but cannot vote. A member can not be censured twice for the same offense. The result is that the member is put on notice that if he or she repeats the offense, he or she can be suspended or removed from membership or office.
Suspension or Expulsion
Any officer may be removed by a two thirds (2/3) vote of the members in good standing present at any special meeting called for this purpose. No vote on suspension or removal may be taken unless at least fifteen (15) days notice in writing shall have been given to the officer for the reasons for his/her removal and of the time and place of the special meeting at which such ballot on his/her removal is to be taken. At such special meeting the officer to be suspended or removed shall be given a full hearing.
Any member may be suspended or expelled from the club for any cause deemed sufficient by the Executive Committee by a two thirds (2/3) affirmative vote of the members of the committee present at any regular or special meeting. No vote on suspension or expulsion may be taken unless at least fifteen (15) days notice in writing shall have been given to the member with the charge, date and time of the meeting of the executive committee at which time such charges to the member will be accorded a full hearing.
Charges against any officer or member may be preferred by any member in good standing. They shall be in writing clearly stating the facts relied upon and accompanied by all affidavits or exhibits which are to be used in their support. Such charges shall be filed with the secretary, who will immediately notify the president. The president shall call a meeting of the executive committee. The secretary will give at least fifteen (15) days notice of the meeting to each member of the executive committee and to the accuser and to the accused, which notice shall be in writing and will include a true copy of the charges and of the supporting affidavits and exhibits.
Any member suspended or expelled by the executive committee may appeal to the full membership of the club. Such appeal shall be made in writing to the secretary who will notify the president. The president will call a special meeting of the club for the purpose of acting on the appeal. The secretary shall give at least fifteen (15) days notice in writing to such special meeting. At the meeting of the full club, the secretary will read the original charges, the supporting affidavits, read or display the accompanying exhibits, and will read the minutes of the special meeting of the executive committee at which the charge were heard and action taken. A full hearing will be given the accuser and accused. A vote will be taken by ballot of the members in good standing present. A two thirds (2/3) vote shall be required to reverse the action of the executive committee.
ARTICLE XI: Match Rules
All match rules for official competition shall be governed by the affiliated national organizations rules and regulations for such a shoot or competition.
ARTICLE XII: Amendments
Amendments to these by laws may be made only by a two thirds (2/3) majority vote of the members present at two consecutive regular meetings. All members are to be notified by mail / or email regarding the proposed amendments at least fifteen (15) days prior to the first meeting. Where additional approval is required by an affiliated organization the amendments shall not become effective until such approval is given, unless the national organization fails to notify the club within sixty (60) days after receipt of the amendment by the national organization by registered mail. Failure to notify the club in the timeframe allotted shall constitute approval.
